By using this service, you agree to the following Terms and Conditions. Please read them carefully. The terminology used below refers to: "Client", "You", and "Your" meaning you, the user. "The Company", "We", "Us", and "Promo Cloud" means Promo Cloud Media Limited.

1. Introduction

By accessing and using our platform, you accept and agree to be bound by these terms in full. Continued use constitutes acceptance of any modifications.

2. Data Protection & Privacy

Promo Cloud operates as a data processor under UK GDPR. Clients uploading email lists are the data controllers responsible for lawful data collection and usage. We do not sell, rent, or share personal data with third parties, and all contact data is processed under instruction only.

3. Content Responsibility

i. You must hold the rights or have permission to upload any music, media, logos, or artwork.

ii. Promo Cloud is a hosting platform only and does not verify rights ownership.

iii. Uploaders bear sole legal responsibility for any copyright issues.

4. Email Campaign Use

i. Only verified, opted-in contacts are allowed.

ii. Scraped, purchased, or unauthorised email lists are strictly prohibited.

iii. Violation may result in immediate suspension or termination.

5. Prohibited Content

i. Loops, sample packs, or incomplete tracks.

ii. Tracks without proper copyright clearance.

iii. Multiple singles in a single campaign without permission.

6. Takedown Requests

Promo Cloud honours valid copyright notices and will remove reported content swiftly. See our full DMCA Policy.

7. Account Lifecycle

Inactive accounts may be archived or deleted after notice. Unused credits will not be refunded.

8. Payment

Payments are due within 7 days. Late fees apply after 60 days. Returned payments may incur admin charges.

9. Termination

We reserve the right to suspend or terminate accounts for violations of these terms without notice. No refunds will be given for services already underway.

10. Limitation of Liability

Promo Cloud is not liable for indirect, incidental, or consequential losses arising from use of the service. We do not guarantee uninterrupted availability or freedom from errors.

11. Amendments

We may revise these terms at any time. Continued use constitutes acceptance of the latest version.

12. Legal Jurisdiction

These terms are governed by the laws of England and Wales. Any disputes shall be settled in UK courts exclusively.

13. Right to Refuse or Remove Service

Promo Cloud reserves the right to refuse service, suspend, or permanently remove any content, campaign, or user account at our sole discretion. This includes, but is not limited to, cases involving:

i. Repeated copyright complaints or legal disputes.

ii. Use of unverified email contacts or excessive bounce rates.

iii. Abuse of platform functionality or behaviour deemed harmful to our service or brand.

These actions may be taken without prior notice and without refund of any unused credits or fees.
